So my daughter's new to her 2017 X3 discussed in the other thread has been deemed a write off. Looks like she is in for a fight. The settlement offer was about $5300 less than she paid for the car from a BMW dealer about 7 weeks and 1500kms ago.   >:(

That's a pretty big gap.

Is she in a rush to replace it?

Now drives a Jaaaaaaag...and thus will not pay for anything during an outing...but it is OK, because....I drive a Jaaaaaag.

What's the average price on Trader to buy a replacement right now?  Time to do some homework.  I understand that pushing back usually gets you more, but there is legwork involved.

Offer is about 3700 below the average price of all 2017 X3's (within 10K+/- of her mileage) currently offered in eastern Canada.  No way of telling how many of the cars going into this average are a.) base models (Hers was nicely optioned) .... b.) do not have clean a carfax.......  c.)  not BMW CPO'd

When I buy a car and get it insured they always ask me what I paid for the car. If your daughter stated price paid to them 7 weeks prior then that should have some bearing on what they pay out. I would think so anyways.  ??? If not why do they ask for that info?

Oh man, that sucks for your daughter.  It's never fun having to fight with an insurance company.  Some painful life lesson are being learned right here.  I hope that it works out for her and she is able to find a suitable next vehicle.

i had my one year old car stolen in 2011 and had to deal with insurance and it was a pain in the ass for one month
the problem is they are supposed to replace my car with the exact same model but if you want a check to buy a different model or mark then for sure you will loose some money because  insurance companies buy hundreds of veh per year and have a special deals that you cannot do it yourself

We are still in dispute. After we did a bunch of research (dealer friend got auction results for 2017 X3's for the past 2 months and calculated average asking price of X3's of similar mileage and trim with clean Carfax's in the region) the insurance company's second, and according to them final, offer still came in about 3K below what she paid 7 weeks before the accident.  Both dealer friend's I spoke with indicated that if anything her car would be worth as much or more now  (stronger market right now than winter). I'm guessing the problem is we paid at the upper end of the price range but it was a local, nicely optioned, accident free,one owner CPO'd car that had received all new brakes and tires as part of that process

Only option now is either arbitration (costs apply and takes time) or suck it up and take the low ball offer.  Given the relatively small amount of the dispute and no guarantee of success the latter may be the smarter ( but more annoying) choice. I am told the company (Royal Sun Alliance)  has been recently bought out and new owners are on a cost control kick. That may explain the unwillingness to pay full market value.

She is going to take the weekend to decide.

What's next may be problematic as there are no X3's around with the options she wants. She wants to buy CPO'd and is reluctant to buy sight unseen so Covid restrictions limit her choice to NB cars.

Well that definitely sucks.  I think you are likely right that taking the sure thing might be the better choice.

So she has her heart set on a BMW X3.  Well as you know the options in NB are going to be limited.  I wonder if the dealer could go through their customer list to see what they sold locally that would fit her needs and then see if the owner is interested in trading it in.  They might be able to see what leases are coming up too and maybe there is some there that she could get.

Unfortunately it sounds like this is going to cost her some money and time.  It’s too bad it wasn’t a better outcome.

Quite a bit considering it was a rear ender on a left turn in an intersection if I understand the details which I probably don't.  Insurance rarely makes the policy holder whole.  Receiving a low settlement really burns from a wreck when you're not at fault. 

In the good ole days under the Tort system all you'd need to do is complain about headaches/neck/back and presto you'd get your proper payout.  Sucks today.
