Yep, Jag went last Spring
She's actually running around in her mother's 328  ;D
(My wife has health issues and practically never drives anymore.)
Old Jag convertible...one itch I won't have to scratch again.

My wife's cousin ran into the exact same thing a couple years ago, had just bought a used 2017 WRX and was rear ended weeks after he got it and the insurance company really lowballed him on the payout. Can't recall the exact outcome but he ended up replacing it with a brand new 2019.

I had a friend That had the same situation and i think it worked out.  They gave him a low ball offer and he refused it and send the insurance company a some similar examples of cars from Kijiji and auto trader with higher price.  They did ended up offering higher but they were paying his rental while they were arguing so time was on his side.

Royal Sun Alliance refused to pay for any more rental fees after their first offer was refused. We sent multiple examples of similarly equipped X3's with similar mileage in our region supporting our market value estimate (pretty much about what she paid in late Feb). They waited 7 days to respond (7 days my daughter was without a rental)and then came back still about 10% under fair market value.

Hows the 328i holding up? Experiencing any of the common N52 issues? Leaks, misfires, cooling?

What about having an independent appraisal completed? I realize the car has been written off, but having someone prepare a report with market valuation going over pre-accident condition, options and comparable offerings in the current market place might actually compel them enough to increase their offer.

The 328 has been good so far (of course it just rolled 60,000 so.....)

That would be the next step. We pay for an independent appraisal .   If it is different from theirs it goes to a 3rd party arbitrator (could take 3-4 weeks and we split costs with RSA). As we are only fighting over a few thousand the problem becomes is the  cost, time and hassle worth it?

Just to close this thread.....She decided to accept the offer.  Very annoying to  feel like you are being taken like this but the cost of an appeal, uncertainty of success and time delay involved  all seemed to make it not worthwhile.  Canada could really use some US style consumer protection laws.

Worst part is, not only did they not pay what they should have, your daughter's premiums are definitely going to go up, too. 

Insurance is such a :censor: racket.  I feel like seeing as you're legally mandated to have insurance on your vehicle, it should be public insurance.  That would keep profit out of the equation.

I assume with an at fault accident on her record there's no point in switching providers.

Well I'm hoping she still had her accident forgiveness when she had this at fault accident.  That way it won't affect premiums.

It's a sucky situation but it's best to move on and learn something from it.  Yet another person who will forever hate dealing with insurance companies. 

Now the more difficult part happens, finding a replacement vehicle (likely she has her heart set on another BMW X3).  With the borders pretty much all closed and the selection so limited here in NB your wife might be without her car for a while longer.

Why not just get something that she'll like and drive for 3+ years.  No point in getting a beater while she tries to find her forever car.

I'd expand the search to Ontario. Find the spec she likes and a forum member can inspect it to confirm its condition. Then have it shipped. It worked out well for me.  :)
