KMS Fine Cars: A story of unprofessional conduct

I just wanted to post a brief experience I had with KMS Fine Cars when attempting to purchase a car.

Recently, I put money down and signed the papers for a car from KMS. I called back only to find out that they had sold the car to someone else, and would be keeping my deposit amount. The sales person I was dealing with apologized and assured me that I could get my money back from them. He said he would talk to the owner and call me back that day.

I called him back the next business day and could not reach him. Called back the next business day, he said that the owner was not around and that he would have to call me back the next day. Two business days later I called back and found out that the owner was in Montreal buying more cars, and did not have a cell phone that he could be reached on (yeah, right). Finally, the next business day, I was told to contact the owner directly to get this done. A few days later, I was finally able to get in touch with the owner directly. He yelled at me saying that he would be keeping my deposit and to feel free to get in touch with a lawyer.

Typically, I always buy my cars directly from the official dealerships, and I have had incredibly positive experiences with BMW new and pre-owned deals. I felt like something was a bit fishy when I came across KMS, but given the value of the cars in their show room and how I'm used to the official dealerships, I forced myself to relax about it and move forward with the deal.

I'm not worried about having legal difficulty with this one so no need to provide sympathy or advice. This is just a heads up: if you come across these guys, just walk away and look elsewhere. There's probably a good reason why their cars are parked in their showroom instead of in the hands of buyers or back at the dealerships they were initially purchased from.

I'd call everyone...including the police.  That's theft, plain and simple.  Call the BBB, any used car associations, EVERYONE.  Make it a bit miserable for the guy.

Maybe Arctic can offer some additional advice.

How fast is my Supra?  I sh*t on Cessnas from a roll....

No, no....a brick through a plate glass window is all you need.  Deductible too high to go through insurance....so they would have to pay out of pocket.   :rofl2:

My first ever GM ownership experience  can best be described as   "Fool me once...."

That is just outrageous conduct on their part.  Be sure to document every step you take.  Except the brick thing.

Thanks all, Just spread the word and ensure you take your business somewhere else!

This will be easy, especially since we included a term on the bill of sale that says "deposit is fully refundable at buyer discretion." I'm really not sure what the owner is thinking.

I think these guys were featured in another thread some years ago.

I'm a little hesitant to throw a fellow used car dealer under the bus on a first time post with ZERO facts:

1.  in what form was the deposit given?
2.  what model  ??? ::)
3.  was there a trade involved?
4.  what were the numbers?

If in fact a deposit on a car is made via a sales contract and that vehicle disappears for whatever reason then any dealer knows that the deposit must be returned.  No dealer is going to risk this type of complaint to OMVIC.

There is always more to these complaints that is stated.  As many of you GTA car ppl know the Keele Street corridor from Lawrence Ave straight up past Steeles is packed with these independents and the competition is literally "ruthless" so this could be one of those posts.

Hey Arctic:

1. Credit card
2. BMW 335i (irrelevant)
3. No trade involved
4. Which numbers? Everything was very straight forward and no financing was going to be involved.

This dealer seems to be very passionate that the deposit does not need to be returned as per his heated rant over a phone call, followed by hanging up on me, and not returning any calls. I'm not losing any sleep over this as it's an open & shut case and in the end he is only hurting himself.

I have contacted OMVIC this past week and started the complaint process. Everyone, I appreciate the support. I just came here to share my experience and help out any fellow buyers. Take care and good luck!

What reason is "Sid" giving for not returning deposit? What was said during the "heated rant"?

Why go through OMVIC? I'm not familiar with that organization or their complaint procedure but wouldn't a simple call to your credit card company be faster and easier? If the situation really is as straight forward and one sided as you say disputing the charge with the card issuer would seem the easiest solution.

Why not?  If he went through his credit card company that would be the equivalent of brushing it under the rug.  It's not like used car dealers can police themselves.  OMVIC could maybe give the dealer a bit of a hard time.  I'd call the BBB too and lodge a complaint and the UCDA as well.  I'd call anyone I could if I got jerked around when buying a car.

If more people made complaints when something like this happened, maybe there wouldn't be as many douche bag dealers.

I guess that makes sense but I still think that maybe we're not getting the whole story. Surely the dealership is giving some reason (no matter how lame) for keeping the deposit?

I can't imagine it's strictly a case of "we sold the car and decided to steal your deposit"......... but then again I haven't done a lot of business in Toronto  ;D

^^That's the thing.  You don't understand the whole Toronto used car lot thing.  On many roads, there's like 50+ "used car" lots within a few kilometers.  Some of them run by people (it seems) who've only been in the country a week.  Employing tactics that only degenerates use.

In Toronto, I bet you stand a better chance of getting screwed over and being violated buying a used car than you would being involved in a drug deal......and the characters involved might be less shady with the drug deal too.
