Just noticed new car has been painted!

Here's my story.  I purchased a 2011 Toyota Sienna sight unseen that was being shipped in from another lot.  It was delivered on Aug 31 but today (Sept 5) we noticed that the rear passenger door has been painted.  In the direct sun, it has a different shade of black.  I noticed it and then 2 minutes later my father in law was checking out my new van and he noticed it immediately.  The dealer was late delivering the vehicle to me by 4 days and I always suspected something was wrong.

I am extremely po'd over this and want to return it and get a new one.  It drives me crazy knowing that what I thought was a brand new minivan has been in an accident (I'm sure just a minor one) and had to have the door repainted.  Is the dealer required to disclose something like this?

Do you think the dealer will take it back?  Am I being unreasonable?

I'll be going to see them first thing Tuesday to deal with this.

I suspect that somewhere along the dealer delivery highway something happened. It was likely a small scrape that the dealer simply fixed. Obviously not well or you would not have noticed.

That happened to me when I went to pick up my car. They said something happened during the night and something fell against the door. Yikes.

But things happen and they fixed it and gave me a loaner for the two days it took to fix it. They buffed out some slight overspray and today you still can't tell where it happened.

Take it back to the dealer and have them make it right. Don't go balistic, be firm and simply point out the problem and ask them to fix it. Keep your cool and see if they accept responsibility and promise to fix it. If not - well one step at a time.

Who cares what the dealer wants to do or not. Contact the MVIC and your lawyer.

And no, you are not being unreasonable...no matter what you paid for the vehicle. The car was sold as NEW, was it not?

What is the name of the dealer?

I'm with inco on this one - just ask them to fix it...no way they'd give you a "new" one.  Did that dealer even know about it? 

When I worked as a co-op student at the Honda plant in Alliston's paint shop, I saw parts of newly painted cars being repainted frequently...and all of those are surely new cars.

A drip of solvent or a spec of dust would cause a flaw...so someone would sand a hood or door by hand...mask the other parts...and then someone else would hand paint it.  Any "hand" paint job would be different than the robotic paint job.

What I don't like is that we pay for the freak'n PDI...an issue like that should turn up then.
If it flies, floats or f#%&s...rent it.

Did that dealer even know about it?

Not the buyer's concern whether he did or not.

And if the repaint doesn't match the rest of the car as the paint ages which is almost always the case.

And they are so quick to point out a repaint when it comes to trading it in. Why should Dana take an even bigger hit at that time.

So what happened ? Did the dealer agree to give you a replacement?

I had this happen to a friend of mine with an Acura TL.  He bought it, had it for about 5000km, and someone scratched his door.  He took it to a body shop and the owner of the shop told him, such a good car, too bad it has to get painted the second time.  And he told my friend he can tell it was painted when my friend said it was brand new.

My friend ran back to the dealer, made a big scene and the dealer traded the car in for a brand new one, no charge, but my friend had to get a different color. 

I suggest go to the dealer and make a big scene.
