Subaru Tribeca 2008

Has anyone had a vehicle that was taken back by the manufacturer?
Would like to know how to go about this.
I have had a transmission problem from "day one" and have had it into the dealer more times than I can remember for this problem.
Latest visit, after almost a month of working on the car with Subaru Canada, the manufacturer stated the car was okay and that the '
"problem" I and the dealer's service department was experiencing was in fact "normal".
Any ideas?

Look up Camvap and Omvic (if you are in Ontario)

]Bought Subaru Tribeca Ltd 2008 new . Going on the end of my third year with the car and have had a continuous shuddering when accelerating on a slight incline in top gear.  Most annoying as we live just off the highway and travel the highway regularly. Naturally it happens at highway speeds. This has happened from day one!  Mechanics did not initially pick up on tis but did change out the torque converter with no improvement. Took the vehicle to another dealer as I was not getting anywhere with the original dealer. New dealer identified a problem right away, and set about correcting it with help from Subaru Canada. They held onto it for about a month and changed another converter at Subaru Canada's behest. When this did not solve the problem, Subaru Canada wanted the knock sensors replaced. This done, there was no improvement.  Subaru Canada suggested change of plugs....no change. Finally drainage of the fuel tank and use of premium fuel. Again no change!!!  The car was returned to me admittedly still shuddering and jerking at highway speeds when slightly accelerating in top geat at speeds of 80 to 110 kph. The dealer was most apologetic and suggested I keep after Subaru Canada for satisfaction.' Computer monitors attached to the engine and transmission have not disclosed the problem, although the Subaru technician still identifies the problem.
I have tried registered letter to CEO Japan, CEO Subaru Canada, but to date have received no response from Subaru Canada although Subaru Japaan wrote back to say that Subaru Canada has the authority to resolve this issue.
This is an issue that is present in other Tribecas (if you look through the forums). Even as far away as Australia and the USA.  am at the point of going to the CMVPA to see what they can do.
Subaru advises this is normal operation for this vehicle.  Certainly not like any vehicle I have ever owned!! And I have had many1 >:( ???
