The OP didn't threaten to sue the dealer.

Who said he did?

Quote
There was no mention that they could not produce the car.

The dealer treated these people very poorly (calling them liars).

If they could produce it why wouldn't they sell it?  Roll Eyes Or were they just holding out for more than MSRP on an '09 Sonata? (Where is the common sense here?)

And actually, they "basically" called them liars, which means the poster interpreted something other than "you're a liar" to mean "you're a liar." They may have indeed treated them poorly.

It won't make one bit of difference to the op's situation to determine who dropped what ball. Even if the dealership is totally at fault and even if the words "automatic transmission" are clearly written, there is nothing that can force the dealership to produce a car for the op. Now if the dealership was refusing to give the op's money back and were claiming that the op never mentioned an automatic, then there would be an issue to get excited about. As it is, the op won't buy a car from this place and the dealership has lost a potential customer. Shite all around but that's really the end of it.

It won't make one bit of difference to the op's situation to determine who dropped what ball.

Did I say it would change anything Huh  Roll Eyes

If we could see the agreement then CTC members could educate/familiarize themselves with the Ontario dealer purchase agreement and LEARN.  Either the OP didn't proof read the agreement or the dealer completed the sales agreement hoping they could score a vehicle from somewhere and then came up empty.  Without viewing the purchase agreement it will be forever unknown.  Smiley

But we were told that a Blue 2009 Accent would be able to be shipped in.
Quote
I knew these options were available because I called about six other Hyundai dealerships, and found this information out

The car he wanted was available. The dealer told him a Blue one was being shipped. Even if the dealer did misunderstand (after multiple times of being told) about the automatic the OP checked with other dealers and an Auto in an acceptable color could have been aquired.

Quote
The salesperson I dealt with checked with someone to ensure this could be attained, and that the price we wanted could be given

The MSRP was shown on the sales agreement but no where does it show the OP agreed to pay MSRP for an 09. WHy would you try to buy a year old model if you were not getting a price break?

The OP said we told you several times we wanted an Automatic. The sales manager says they never specified Automatic. WHat else can you take that as ? "I told you Automatic, I signed for an automatic" NO you didn't! In other words you a re lying. WHat you are saying is not true and you KNOW its not true.

Its not hard to read between the lines.

^^^^Just to point it out...we are only hearing one side of the story.  Who knows what's true and what's been exaggerated....

Well that pretty well goes qwithout saying. Its true for any post. You only hear one side of the story. If we simply shoot down every compaint with "We don't know the other side" we'd never get anywhere. We have to guess. It sounds like they told them several times they wanted Auto. They test drove an Auto. They can't drive a stick. They called several dealers to see if there was an Auto avialable. It would seem that pretending to want a manual to get a lower price would not be a very good barganing tool? So I'm inclined to belive the idea that they said Auto and the dealer screwed up.

I'm starting to belive that the dealer was trying to set them up for  a "Bait and Switch".

By law the OP is intitled to his deposit back, but the dealer was probobly waiting/planning to upsell the OP to an automatic or a 2010 model.

The buisiness of calling the OP liars only made things worse.

Isn't "Bait ans Switch" illegal anyways?

take the money and go to another dealer, Newmarket has one on Leslie St north of Davis Dr. ALWAYS read the contract before signing to make sure its what you want.

ALWAYS read the contract before signing to make sure its what you want.

Better yet; ask for a clear photocopy of the yet unsigned purchase agreement and go away for a few hours.  Also do not bring either a credit card, debt card, or cheque with you or more than 50 bucks on the initial visit.
