Extended Warranty Issues With my Jaguar

I purchased a used Jag two years ago from a used car dealership. The purchase included extended warranty as part of the deal.  I have been regulary changing oil and there maintenance work, through my friend's garage. since these are cash dealings, I didn't obtain any receipts. Two years and 45000 km later, I am having transmission problems. I got it diagnosed from the jag dealer itself. I took it to the dealer (I bought from) they arranged for the the warranty company authorized garage to fix it. I went on vacation for a month and came back to find that the issue has not been resolved. I paid a 100 bucks for the part. all this while I was under the assumption that all these repairs were taking place as part of the warranty. When I took it back to the same garage. They said the tranny is gone.

In the meantime, I check with the dealer about the warranty information, they say I must have gotten it in the mail within a few of the purchase. When I bought the car, the salesman didn`t tell me anything about how the warranty is activiated or what has to be done in order to make claims or even preserve it. Since they are selling it, they are supposed to let us know, these are the thnigs to be done. Since I didn`t want to waste time, I asked the tranny guys to rebuild the tranny and have decided to pay from my own pocket in order for me to be mobile. I also called the warranty company giving them, my last name, my car model and make and also the dealer name and they are not able to trace any policy related to this car. The service guy from teh dealer is not giving the policy number. He wants the receipts to ensure that I have maintained the car. Though Initially they admitted that they didn`t instruct me about activating the policy.

What are my options?

Please advise..
do I have a legal standing. ?

P.S The only thing I got with the car was the sales receipt with the warranty specified in it and a flyer from the warranty company detailing the prices of their various products.

Based on the info given here, it sounds like you are probably toast on getting the transmission paid for since you cannot prove any maintenance was done. Providing records of maintenance is a pretty standard part of any warranty.

You may have some claim against the dealer over the cost of the warranty, if indeed there was no warranty ever purchased. Call OMVIC for advice.

This is pretty normal stuff for third party warranties. First, without documentation for fluid changing, you will have no legal standing in court.

As for recovering the actual cost of the warranty in small claims court, you have to weigh the prospects of what you will recover against the cost in time and fees to try to get said funds. Warranty companies will spend like no tomorrow to prevent this kind of case ending in a court victory to prevent a floodgate of future suits.

Is this a third party warranty or a Jaguar CPO warranty?

Regardless, you must have proof of scheduled maintenance being completed (receipts or Jaguar service book filled out and stamped by dealer) in order to get any extended warranty coverage. That covenant is written into all extended auto warranties.

This is a third party warranty. I have two oil change receipts (along with other maintenance stuff)  in the car ( or at least I can get it from Mr.Lube and the Jag Dealership). My mechanic has asked me to come today to pick up the rest of the receipts. Hopefully that should suffice. The guy I am dealing with at the dealership has not returned my calls. I am surprised the warranty company and the garage (that is authorzed by the warranty company) is only asking for the warranty policy number. I was planning to get a nice convertible (the only thing that was holding me back was the winter driving) in the ensuing months, again looks like that has to wait for a year now. I am happy with my jag other than the high maintenance. But this tranny thing with the dealer came out of nowhere.  I don't think I have any issues with the warranty company itself. If the dealer had told me that these are the activation procedures, I would certainly have followed it. I called OMVIC initially, but they said the best course of action is to go through the dealer and after much insight into their activities, I think they will act only as mediators and have no control on how things work and all that.  I agree with the fact that there is no winning against insurance and pharmaceutical or even tobacco companies :) .

Considering the fact that the warranty company could not find any of my records, is it possible that the dealer didn't purchase a warranty at all?

That might be the loophole you need. If they sold it to you and didn't register it you might be able to leverage that and maybe get some of your money back.

On the other hand maybe you had to register it and not them. That might be the case and the out for the dealer, but the warranty company should be able to advise.
