How to sell BC licensed car in Ontrario (urgent!!!)?

this is giving me alot of troubles... I am leaving Canada soon... so I wanna get rid off the car...

1. the car is from BC with BC insurance. didn't change the plate because of the insurance (I know its illegal....but... well)
2. I have unpaid parking tickets... if I change the plate to Ontario, do I have to pay the unpaid tickets?
3. Is there any way that I don't have transfer the plate to Ontario and then sell the car?

I called the driver and vehicle office they told me to do emission and safety test.... and then just provide a bill of sales. Can someone please help me? please reply on this forum or email me @ maidintaiwan@hotmail.com

I am not sure...what to do...
just my potential buyer saying that I need to transfer it in to Ontario's plate before I can sell it.

Your buyer is wrong.  Just provide a bill of sale.  You're not even obligated to do emission and safety tests - the buyer will have to do them before registering the car.  However it's probably easier to sell the car if the buyer knows that the car has passed the emission and safety tests.

So listen to the MTO and just worry about providing a bill of sale.

What make and model?  If it's a beater then sell it as is with the BC ownership, but remove the plates.  In BILL OF SALE write "as is, no warranty" and date the document with actual time of day, not just the day.  Try and get the buyer's DL # on the Bill of Sale.  This identifies the buyer more than their name does.

The problem with getting Ontario plates, other than the safety and e test, is that you'll need Ontario insurance and an Ontario DL.  Phone about the unpaid tickets.

well.... its a Toyota Camry XLE V6 2003.... yeah... I guess I won't be able to get a Ontario Insurance and DL for my mom in just 1 or 2 weeks....

  If your selling the car the buyer will be paying sales tax when they register it regardless of where it as last registered. Also i believe there is a time frame for you to reregister your vehicle where it may be brought into the province as settlers effects before you would need to pay a sales taxes yourself if you are reregistering it before the sales. If your selling it, all signing a declaration is going to do is provide evidence of an illegal act (failing to reregister your vehicle in the province of residence), not relieve anyone from paying the sales tax.

yes... I know the Buyer is going to Pay the sales Tax... but does the buyer need to pay the transfer tax as well??? (from BC to Ontario)

  The "Transfer" tax as of 5 years ago when i moved back here was the Sales tax. There wasn't any other tax. Other fees of course but no other taxes. I had a car I had before I move out west that I drive only part of the year and so didn't re-register in Ontario until the spring after I moved back when I wanted to put it on the road for the summer. The license people were determined I had to repay the sales tax as I was just outside the time frame when it was considered settlers effects, until I was able to prove that I had already paid sales tax in Ontario on that car once. Once I presented the original bill of sale showing sales tax paid in Ontario the new plate were issued with in 2 minutes.

  By checking out the Ontario ministry of transport site at http://www.mto.gov.on.ca/english/dandv/vehicle/rgoutcan.shtml  you can read the requirements yourself and see that hasn't changed.

Yes, that's what it means.

The MTO (Ministry of Transportation of Ontario) doesn't care if or where a car is registered on the seller side.  All the MTO cares about when a buyer goes to register a new/used car is:
- does the car have the proper safety and emissions certificates
- does the buyer have the ownership signed over to him/her and (preferably) also have a bill of sale
- has the buyer paid the 8% PST
- does the buyer have a valid driver's licence and proof of insurance

That's it, that's all.  In your case as far as the MTO is concerned it doesn't matter where the car was registered prior to the buyer coming to register it after the sale.

another question...
what does a owner ship look like??? what does that sheet of paper look like?
is a "motor vehicle sale or purchase agreement" ownership? or theres something else?
if I couldn't find ownership, how can I reapply one?

Do you have your BC plates?  Do you not get a piece of paper in BC with the plate info on it?  The other side is the ownership... at least in Ontario it is.

so how can a buyer do a safety test?? after we transfer the owner ship and registered in Ontario....
cause I thought my BC insurance will be cancelled after transfered ownership....??

whats the proper way of doing this???

my Guess would be....
1. sign over the ownership
2. provide bill of sales
3. get the safety and emission test + drive clean (like... how????? drive uninsured?)(cause I am not qualified to do the test with BC plate??)
4. get insured after the tests (if all passed)
5. Get a plate...

sigh... I am so confused...
