Topic: Justice for neglect on Canadian Tire

If I make a mistake and smash something, that's what my insurance is for.  If someone else is neglectful and damages my property I don't call my insurance, the other party is responsible.  Why should someone have to put a claim in on their own insurance for that?

That's what I meant by "that's what insurance is for" - Canadian Tire's insurance, not her insurance. Sorry that wasn't very clear.

This country seems to be becoming like the US where you sue for whatever you can get and hope the courts award you some money. Was the driver hurt? No. Was CT willing to fix thier mistake? Yes. End of story then, IMO. I do agree they should get her a rental car. Had she been injured if the wheel had fallen off on the highway, then yes, sue for negligence - but that wasn't the case.

I'm still curious if the vehicle required brake work or if it was okay.

"My daughter takes her car into CT " - That is mistake #1, never go to Canadian Tire for auto service. I find that they are very incompetent when it comes to repairs. That's why're they're nicknamed "Crappy Tire".

It's okay to buy auto parts from there, just don't get a car serviced there.

At least she's okay. Take the car to any certified bodyshop that you choose and Canadian Tire is responsible for the payment. Let them pay for a rental car as well.

If your daughter didn't suffer any injuries, than you can't sue for anything.

Squishy Yes we do have a MTO or DOT as well as they are the Ministry of Transport and the Dept of Transport which are seperate but almost the same. There officers would go out and investigate this incident and have the power to lay charges over it as well. They could shut the entire shop down there if they wanted so its the owners best interest to resolve a problem like this as quick as possible. I have used their services a few times over the years myself for a rotten or crooked garage.

I've never heard of any DOT in Ontario.  We have the Ministry of Transport in Ontario, and Transport Canada at the federal level.  I think some provinces like New Brunswick do have a DOT, as do the States.
