If he is a flight risk and has a history of failing to attend court I guess. If that's the case then the conditions are usually more restrictive and don't have a time frame. However, I'm sure different jurisdictions do things differently.

Yes, first court date is in a little less than 3 months (or 2).


If he is a flight risk and has a history of failing to attend court I guess. If that's the case then the conditions are usually more restrictive and don't have a time frame. However, I'm sure different jurisdictions do things differently.

What makes someone a 'flight risk'? He has no history of failing to attend court, heck he's never been in court before.

All we look at is their history of attending court and if there's something in another area that might cause him to go there and not return. For instance, did he recently come here from Alberta, has family there and has nothing to hold him here? Then we might request a condition to keep him in the general area however that condition has to be imposed by a Justice of the Peace, not an officer in charge. Did he spend the night in the bucket and see a judge in the morning?

I see. He did mention he'd seen a judge, I didn't give it much importance though.

We release most people we charge on what is called a Promise to Appear. Basically it commits the person to attend in court on a certain day about 6 weeks down the road. Unless they were asking for some obscure condition I don't know why they made him see a judge. But like I say, to each their own.

Now that I think about it some more, they can put a condition on an Undertaking before an OIC that he stay in a certain jurisdiction....Making me wonder even more why they put him before a judge. Was he an swerver to them?

I have a brother in law who is fighting a DUI at the moment I heard to-day thru the family. He has had some of the charges dropped, some very strange circumstance have come out at his trial in Stratford and the condition of the street he was driving on at the time. The actual trial has been postponed while new evidence keeps coming in for a month now with 5 appearances already defending this . They have also kept dropping the different ways of charging him as they were wrong apparently. Apparently the street was totally shell holed from severe construction there and all traffic had to dodge a lot of holes which makes them look like they have been drinking. The 2 cops in the cruiser can't even agree that he was drunk or even doing anything wrong as well. Should hear more next week. I think they were over the 2hr limit on testing him and are trying to go by his behavior?  :)

I gave him 'the lecture' don't worry about that. It was also the SuperBowl night, I really don't know what was in his head.

As he's my friend, I did give him a hard smack in the head but I'm also going to help him out.
He's lucky to have a friend like you.  Also, we're *all* lucky that we weren't within the splash radius of his stupidity.  I say that without any trace of judgement, BTW.  I hope that if I do something remotely that stupd that there will be somebody to kick me in the a$$ then pick me up like you did for your friend.
