It appears that the police did not see him driving the vehicle nor did the Crown produce witnesses to testify they saw him drove into the Timmie parking lot or Timmie security video showing him driving the SUV.   The Crown probably had a weak case with circumstantial evidence. 

The law could be rewritten to say one can't be sitting in the driver's seat while under a driving prohibition.  Then the police would have caught him in the act.

Personally I think he should be charged.

He was charged; charge was thrown out because the judge said he was not driving.

Sorry, I meant convicted.
A subwoofer should only be noticed once it has been turned off.

Seems like a case of stupid Police work. Invoke some patience and nail the dude  the moment the vehicle moves.
