I'd bet that follow-too-close is the #1 cause of collisions. It should have a $10K fine and 2 year license suspension. Get caught driving suspended? 2 years in the clink.

Right now, that sounds good to me... I suppose the guy can say he had to flee the scene because he feared for his life from the angry victim.
He could... except, he is quite bigger then me so a judge might have a hard time swallowing that one. After he lied about being close behind me for a few minutes and being on the phone, I lost all interest in talking with him, so I told him to f-off and talk to the cop whenever he gets there. Had I known that he has the legal option of not sticking around, I might have been a little more receptive in talking to him. I wanted the cop to do it, not me. I guess he was just doing the "right" thing because looking at the back of my policy, there is some small print about what to do in case of an accident, it says something to the effect "never admit liability"... Did any airbags go off?
No. do U think the car is repareable to your satisfaction...suppose that decision is out of your hands..and did U have replacement (i.e FULL VALUE) as an insurance rider..........??
I don't know if it can be repaired well to be honest. I am concerned about it. I'll have more info and pictures on Monday. Yes, full value insurance for first 24 months, we're 18 months into it... As for the trade in depreciation I wonder if one can get the paperwork showing the difference in value btw a normal car and the accident vehicle, so that later on you could file a claim to a small claim court against the a-hole. We really need Mitlov's expertise here  Well, I'm going to try to get that documented and I would bring it up with the insurance company. If they refuse to acknowledge it, then I may go to small claims... If they write off the car, are you going to try and find another Mz6-Hatch or something else?
Wife wants Mazda 6 hatch again if we can find one 2008 model, I'm not sure what I want yet... We looked at the new M6 and are disappointed: bigger, no hatch & no manual, all deal breakers for us. I'll start a "what to buy" thread if and when the time comes. |

Unfortunately, Ontario insurance regulations deny this type of action.

As unbelievable as it sounds, once the cost of repair reaches 85% of the cost of replacement the insurer writes it off without exception. However, this is the maximum limit. Different companies may have lower maximums. Perhaps Quebec insurance is more reasonable assuming your car is insured in QC.

Is "full value insurance" in PQ the same as "waiver of depreciation " in Ontario?
If so you should get a new car if the Ins co writes it off. |

I ask people during their statement "Did s/he say anything to you afterwards?" and they might say "The guy said 'Sorry, I was on the phone shifting gears and typing on my GPS while changing my radio station and didn't see you stop"....Then it gets bumped up to careless driving and not follow too closely. I've had women (young and old) tell me they've left the scene because they were scared of the guy yelling at them. I buy that one especially when the dispatcher tells me they can hear the guy yelling in the background on the 911 call. |

Tough break. I'd be livid too... surprised he could leave the scene.
If it's totalled, the dealer here has a handful of new Mazda6 Sports left... dunno if any are manuals. |

So I did not get any info because the towing company delivered the car to the garage at 4 p.m.. They can't tell me nothing until they pull the bumper and have a look under there. Should be done tomorrow. In all fareness, it looks a little better to me now then it did on Friday... Glad to hear you're doing alright, all things considered. And what an asswipe.  Doesn't look like the door is flush any more. This will not be a cheap repair. Hopefully you'll get a write off. |

Just got word from my insurance company that the person responsible for this mess has no insurance... Good thing I DIDN'T talk to him at the scene. I might have been charged with assault... No word yet on what the damage is... EDIT: Spelling. |

That is a $5000 fine that you can get out of paying, which turns into a cost of over $6000 because of extra charges ( a friend had forget to review his insurance , then got stopped, what a dumb sh$t)
Will your insurance cover the bill, I guess you could also sue the person in civil court |

Insurance is mandatory everywhere in Canada AFIK. In Quebec, the bare legal minimum is with the license plate of the vehicle. It pays damage to other vehicles but not your own for at fault accident. I think I'd be in the hook for a deductable...$500  I have pics with the bumper off, will post soon. Early indications are that it will be repaired not written off. The lady doing the estimate said that at first she didn't think it would be, but she says parts for this car are cheap... She also said it'd have to be 80% of the value before they consider a write off. She was at $8k and counting when I went for a visit. I don’t have the final estimate yet. |

Nightmare Nick, just glad you're OK. The worst thing about all this even when the insurance company is being good is that it takes so much time and effort to sort out.
Fuzz can you clarify why the police would not get his phone records, would it not prove dangerous driving?
In the UK if there was even a hint of using a phone the police would pull the records instantly, and if a death was caused you can get up to 14 years in jail. I still can't believe the amount of people here who use their phones whilst driving, even texting and e-mailing too. |

Dangerous driving under current law: not even a remote chance.
They have this guy for following to close and no insurance with minimal effort. That's considered a success. |
