Saturday night I go out to move my car from the driveway and park it in the garage for the night. I have been drinking and let’s assume I am over the legal limit. My car is parked very close to the street as I was cleaning out the garage that day and made room to place items outside. We will assume more than half the car is parked beyond my property line…..can I be charged with DUI?

I would say yes, because from what I've been told, if you are in the car, with the keys in the ignition, you are considered to be 'in care and control' of the vehicle, and if you're over the limit, that's DUI.

However, I'm not a lawyer, so that's only my understanding.

not a lawyer or cop but I have heard even if you are parked ignition off and sleeping and under the influence you can still be charged,

This topic came up on another forum recently, and while the resident police officers did not have an "always true" answer, their advice was to stay away from your car while under the influence.  Even if you're in the back seat, they said, you could get a DUI.  A DUI (in BC, probably similar elsewhere) is issued if you are in "care and control" of a vehicle while under the influence...  what "care and control" means is debatable, but the consensus was if you're in the driver's seat, you can and will be charged with DUI, and if you dispute it, you will lose.
