Selling Vehicle w/Accident History

So, we might be interested in a new 08' Impreza 2.5i, Sport Pkg, Sedan. We would need to sell/trade in our 01' Accord.

Its in excellent condition, no problems...I just like to change once in a while. However, there is one problem: it was in an accident. $6000 in damage, replaced with all HONDA parts.

Because of this, trade in value will plummet. I know that. IF I sell privately, do I need to let the buyer know that this vehicle was in an accident?

I know about the Seller's package in Ontario, but theres nothing about accident claims: you would need a Carfax/CarProof report for that, correct?

It would seem to me that misrepresentation is misrepresentation, regardless of the client.  Even if the law somehow allows you to do this at the point of sale, you might face a civil suit should the buyer find out about it later.  "Caveat Emptor" only goes so far.

At the very least, your name would be mud. :shake: :thumbdown: :nono:

Oh I know, I am just wondering if there are legal concerns, etc.

I wouldn't lie, but if the buyer asked, I would of course tell them.

I probably won't sell privately, its too much of a hassle, especially if the car isn't perfect. I would most likely keep it.

If you sell privately, chances are the buyer is going to pull a carproof report.  It will come up....

Haha, I actually purchased it in 2004, with ONLY 15,000 kms!!. 2 months later, accident.  :( It currently has 71,000 kms on it.

Sell privately - if they ask tell them. Otherwise don't worry about it. I'll bet a reasonable number of buyers won't ask. I know when I sell cars only about maybe half ask.

Have you seen if a dealer would take it as a trade at all? I remember going to a few dealers with my civic which had 8K in damage 5 years and about 140000 clicks ago and all the dealers I went to categorically refused to take it as a trade. This was in Ontario. Good Luck

They won't put it onto their lots, but they get a wholesaler to purchase it.

supercrip, what did you end up doing with it? Selling it privately for a very low price?

And yes Julie, I would if I traded it in. We almost made a deal with a Camry Hybrid in early 2007. Dealership agreed to give us $10200 for our Accord. When they found out it was in an accident, value dropped to $8000. Ouch. Deal was off.

If you sell privately, I'd tell the person up front.  Chances are they would get a carfax and if they don't know what a carfax is, a friend/family member might tell them after the transaction at which point who knows what they would do.

I'll sell privately, hopefully. I've got a few people at the office interested in the civic now as they know how well the car was maintained. I'm a patient man.... I've put a deposit on and I'm waiting for this

Everything is dependent on final pricing and a few other details.
